Standard Terms and Conditions
Information for birth pool customers
ALL ORDERS ARE ACCEPTED AND GOODS SOLD SUBJECT TO THE FOLLOWING CONDITIONS. PLACING AN ORDER ASSUMES THAT YOU HAVE READ, UNDERSTOOD AND ACCEPTED THE FOLLOWING.
What we need
Prior to manufacture / delivery
- A written order on headed paper specifying the model of bath or pool to be supplied. The order should give a contact name and telephone number for technical queries relating to the bath or pool and any installation. Any modifications need to be stipulated. Colour will be porcelain white unless stated otherwise. Baths and pools will be supplied with or without a standard waste but without taps.
- Any modifications to standard models or any bespoke or semi-bespoke baths must be accompanied by a scale drawing, preferably in AutoCAD, detailing the shape, size and specification of the bath and any modifications. We can offer a drawing and design service at our standard rates which are in addition to any quote for the supply of a pool or bath.
- All orders are only confirmed by written order AND a 10% deposit.
- Any changes to agreed specifications will require a new estimate of costs.
- The installer will need access sufficient to get a bath in, a clear installation area, a waste pipe to connect the bath to at or very close to floor level, and (depending on the bath model) an IPS panel to butt the bath against.
Collection / Delivery
- Upon completion of the manufacture the customer will be informed that the pool is ready for collection. Full payment is required prior to release. At present we do not deliver outside mainland UK. However we will work with you to get your bath to a carrier or other representative in the UK from where you can ship to your destination worldwide.
- Title to the goods shall not pass to the Buyer until payment of all monies has been received in full by Aquabirths.
- Customers should allow at least 6 weeks (30 working days) between the receipt of order and the pool being ready for collection. Additional and unavoidable delays will also occur in August as this is the holiday period for many businesses and suppliers.
- We will inform you when the pool is ready for delivery. If the customer would like Aquabirths to arrange delivery, they should inform Aquabirths in writing enclosing a full delivery address, including postcode, along with any site-specific directions or contact names and numbers. Costs will be calculated at the time of delivery. Quotes will be obtained for your approval. Carrier costs are beyond the control of Aquabirths.
- It is up to the customer to ensure any insurance in addition to the standard insurance (if present) offered by the carrier.
- Faulty Goods. Please check all goods on delivery, especially check the condition of larger items such as baths. Any goods claimed by the Buyer to be defective through faulty workmanship or materials must be advised to Aquabirths within 3 days of receipt of goods or as soon as is reasonably possible. Any goods proved to be defective will be repaired or replaced at Aquabirths' option. In any event our liability is limited to the invoice price of the goods and Aquabirths shall not be liable for any special damages, consequential loss, loss of profits or other expenses incurred. All products sold on this site are fully and comprehensively guaranteed against faulty workmanship or faults in manufacture, enquire for details.
- Shortages. Always check the condition of goods on delivery, particularly non-metal items. Unfortunately no claim for damage in transit or shortage of delivery can be considered unless Aquabirths are advised within 3 days of receipt of goods or as soon as is reasonably possible. Aquabirths must be notified of non-delivery within 10 days of the date of despatch.
If installation is also required:
- We will require written instructions, accompanied by scaled drawing, preferably in AutoCAD format, of the point of installation and the water supply / wastes to be connected to. We need to be informed before installation of any specific requirements, issues or warnings. (E.g. the presence of an IPS panel, medigases, etc.)
- Easy access for the bath or pool needs to be possible to the room or site where the bath is to be installed. It would be wise to ensure that lifts and doors are wide enough.
- Access for our staff or subcontractors must be possible throughout the period of installation.
- We will need the site to be clear of obstruction and for a smooth and level surface on which to mount the bath. Aquabirths need to be informed of factors which may prevent a good fit to the floor. (E.g. if there is any radius or curve between floor (of flooring) and the wall as this may prevent the bath being fitted flush against the wall; uneven IPS panel, uneven floor, etc.)
- It is often the case that the waste trap to the birth pool will be situated in the ceiling void of the room immediately below the pool. This is to ensure maximum head of water to clear the water quickly and to take any ‘birth products’ to the soil stack and minimise the risk of blockage. Access to this ceiling void will also be needed.
- Electricity must be available on site at the point of installation for the duration of the installation.
- Water services and waste soil stacks or waste gulleys must be present for the bath to plumbed to. Aquabirths will require the details of any pipe work to be connected to (for example, diameter of piping, distance to piping) prior to installation. Costings are for connecting the bath, not for laying lengths of additional piping to water supplies or soil stacks at a distance from the bath. PLEASE NOTE. The waste pipe for the bath to connect to must be at, or close to, floor level.
- The hot water feed used to supply hot water to the bath should be regulated by a thermostatic valve. Aquabirths will not fit a thermostatic control.
- Aquabirths will install the bath to connect to water supply and to the waste. Aquabirths will not undertake any work to surrounding fittings such as floor coverings, supporting joinery, any electrical work, or any other plumbing not directly related to the bath.
- Aquabirths will not check the structural strength of the floor. It is the responsibility of the customer to ensure that the floor is strong enough to take the bath in use.
- We will install an Aquabirths bath, purchased from us, at our Installation Rate. Any work outside the installation and not arising from our workmanship will be charged for at our Standard Rate.
- Installation will commence within 20 working days of the order being ready for collection assuming no delay in the arrival of the bath on site. Early or expedited installation may be possible by arrangement and will be chargeable at higher rate.
- Any factor beyond the control of Aquabirths which prolongs the period of installation will be chargeable at the charging rate being applied (Installation Rate or Standard Rate).
What we do / do not do.
Aquabirths will install the bath. This includes fixing the bath in place and connecting it to a previously agreed soil stack, gulley or other waste. If previously agreed, Aquabirths will also connect taps to previously installed pipework.
We do not undertake any work on: floor coverings; any electrical work; any plastering; joinery or other plumbing other than that specifically connected to the installation of the bath as outlined above.
Manufacturer’s warranty. The bath (excluding taps and fittings, which will have separate warranties via their manufacturer) is guaranteed for workmanship and materials for a period of 36 months when used correctly.
Installation will be undertaken by a sub-contractor and not by Aquabirths. Any installation warranty will come from the sub-contractor, not Aquabirths.
